It is stated who is the most appropriate inventor or patent owner of inventions interacted by Artificial Intelligence (AI). Based on the opinion of the government, the process of inventions and which entity (human or AI) plays the role in each process are analyzed. The result of this study shows that assuming AI do not have intention itself, inventions interacted by AI would be recognized as ones human use the AI as “tools”, and the human could obtain the inventorship followed by the current patent law. And it concludes that patent ownership rights could vest in the entity which do “advance learning” to AI, give the AI demands of human and play reduction to practice (discover the conception of the inventions). |
